Welcome to powertower.ltd. These terms explain the rules for using our website, joining our waitlist, and paying a reservation deposit. By using our website, you agree to them — please read them carefully.

We want to be completely straight with you.
  • PWR TWR is not yet a finished product available to buy. We are in a pre-launch phase, preparing to launch a crowdfunding campaign on Kickstarter.
  • Images, illustrations, renders and specifications on this website are indicative. The final product’s appearance, features, materials, colours and technical specifications may change as the design is developed and manufactured.
  • Paying a reservation deposit is not the same as buying a product. It reserves your place and your discount. It is not a purchase, and it does not guarantee that a product will be manufactured or delivered.
  • We cannot guarantee that our Kickstarter campaign will succeed, or that PWR TWR will ultimately be manufactured or shipped. Product development and crowdfunding carry genuine risk.

Joining our free waitlist means giving us your name and email so we can send you updates about PWR TWR and our Kickstarter launch.
  • It’s free, and creates no obligation on either side.
  • You can unsubscribe at any time using the link in any email, or by emailing dale@powertower.ltd.
  • We handle your information as described in our Privacy Policy.

The £25 reservation deposit

This is the most important section. Please read it in full.

4.1 What the deposit is

Paying a £25 reservation deposit reserves you a “founding backer” place ahead of our Kickstarter launch. Subject to these terms, it entitles you to:
  • a discount of up to 35% off the intended public launch price, applied when you complete your purchase during our Kickstarter campaign;
  • founding backer status, meaning we intend to prioritise you in our first production batch and for early dispatch;
  • early access to our Kickstarter campaign when it launches; and
  • an invitation to give feedback on design choices such as colours and modules. Feedback is genuinely welcomed, but final design decisions rest with us.

4.2 What the deposit is not

  • Your £25 gets you
  • Up to 35% founding-backer discount
  • Priority in the first production batch
  • Early access to our Kickstarter launch
  • A say in design feedback
Your £25 is not
  • Payment for a product, or a sales contract
  • A guarantee PWR TWR gets funded or made
  • A reservation of one specific physical unit
  • An obligation to buy anything later

4.3 Your refund rights — you can get your £25 back at any time

Your £25 deposit is fully refundable at any time before our Kickstarter campaign closes. Simply email dale@powertower.ltd and ask. We’ll refund the full £25 to your original payment method, normally within 5 working days. You don’t need to give a reason.
This is in addition to your legal rights as a consumer, including your right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel within 14 days.

4.4 How the deposit is applied

If you go on to back PWR TWR during our Kickstarter campaign, your £25 deposit will be refunded to you in full once your Kickstarter pledge is confirmed. This is because Kickstarter processes pledges directly, so your deposit cannot be deducted from your pledge automatically. Your founding backer discount is applied through the reward tier available to you on Kickstarter.

We will email you full instructions when we launch.

4.5 If we don't proceed

If we decide not to launch on Kickstarter, or the campaign does not reach its funding goal, or we otherwise decide not to proceed with the product, we will refund your £25 deposit in full. We’ll email you to let you know.

4.6 Limits and availability

Founding backer places may be limited in number. We may close reservations, or change the discount offered on future reservations, at any time. We will always honour the terms that applied to a deposit you have already paid.

4.7 Payment

Deposits are taken in pounds sterling and processed by our payment provider, Stripe. We do not store your card details. You confirm that you are authorised to use the payment method you provide.

Using our website

You may use our website for lawful personal purposes only. You must not:
  • use it in any way that breaks any applicable law;
  • attempt to gain unauthorised access to our website, servers or any connected system;
  • introduce viruses, malware or any other harmful material;
  • copy, scrape, republish or commercially exploit our content without our written permission;
  • misuse our website in a way that damages it, or affects other users’ access to it.
We may suspend or withdraw access to our website, or to any user, at any time and without notice.

Our content and intellectual property

All content on this website, including text, images, renders, logos, designs, video and the name PWR TWR, is owned by us or licensed to us, and is protected by intellectual property law.
You may view and print pages for your own personal, non-commercial use. You may not otherwise copy, adapt, distribute or use our content without our written permission.

Accuracy of information

We try to keep the website accurate and up to date, but we don’t promise that everything on it is complete, accurate or current. This applies particularly to product specifications, which are still in development, and to any pricing or timing indications, which may change.
Nothing on this website is intended as advice you should rely on. Please contact us if anything is unclear.

Availability of the website

We don’t guarantee that our website will always be available or uninterrupted. We may suspend, withdraw or change all or part of it without notice.
You’re responsible for arranging your own access to the internet, and for making sure anyone accessing our website through your connection is aware of these terms.

Our responsibility to you

We never exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for any of your statutory rights as a consumer.
Subject to that:
  • We provide our website “as is”. We don’t accept liability for loss or damage caused by viruses or other harmful material you may encounter through using our website or anything linked from it.
  • We are not liable for any loss or damage that was not foreseeable. Loss or damage is foreseeable if either it was obvious that it would happen, or you told us it might happen before you used our website.
  • We are not liable for business losses. Our website is provided for domestic and private use, and we have no liability for loss of profit, loss of business, business interruption or loss of business opportunity.
  • Where we are liable in connection with a reservation deposit, our total liability is limited to the amount of the deposit you paid.

Changes to these terms

We may amend these terms from time to time. The “Last updated” date at the top tells you when they last changed. Please check them each time you use our website.
You also have the right not to be subject to automated decision-making that has a significant effect on you. We don’t do this.
If we make a significant change that affects a deposit you have already paid, we’ll email you.

Your privacy

We only use your personal information as set out in our Privacy Policy. Please read it — it explains what we collect, why, and what rights you have.

Complaints

If something’s gone wrong, please email dale@powertower.ltd

and tell us. We’ll acknowledge your complaint within 5 working days and do our best to resolve it fairly and quickly.

General

  • If any part of these terms is found to be unlawful or unenforceable, the rest remains in force.
  • If we delay in enforcing any part of these terms, that doesn’t prevent us enforcing it later.
  • These terms are between you and us. Nobody else has the right to enforce them.
  • We may transfer our rights and obligations under these terms to another organisation, and we’ll tell you if we do.

Governing law

These terms are governed by the law of England and Wales, and any dispute will be dealt with by the courts of England and Wales.
If you live in Scotland, you may bring proceedings in Scotland. If you live in Northern Ireland, you may bring proceedings in Northern Ireland. Nothing in these terms affects your statutory rights as a consumer.
